Are Oysters Halal? What Each School of Thought Says
It depends on your school. Shafi'i, Maliki and Hanbali scholars allow all sea creatures, and a Darul Ifta Birmingham summary names oysters as permissible in these schools [3]. The Hanafi school allows only fish from the sea, so oysters are not allowed [4][5]. Ja'fari rulings say shellfish is not halal [6]. If you're unsure, ask a scholar you trust.

Where the ruling on oysters comes from
The Qur'an makes the game of the sea and its food lawful [1]. A well-known hadith in Sunan Abi Dawud describes sea water as pure and what dies in it as lawful [2]. These texts are the basis for every school's ruling on seafood.
The schools agree that fish are halal. They disagree on whether the permission covers every sea creature or only fish. Oysters are not fish. They are shellfish that live attached to rocks and reefs. So the answer depends on which reading your school follows.
The schools that allow oysters
A summary of the four schools from Darul Ifta Birmingham reports that the Shafi'i and Hanbali schools treat all sea creatures as lawful, whether or not they are fish. It names oysters, along with shrimp, lobster and crab, as permissible on that basis [3].
The same summary says the Maliki school also allows sea creatures broadly, with the eel noted as its exception, and it lists oysters as permissible there too [3].
For scholars in these schools, oysters need no slaughter. They fall under the general rule that the dead of the sea are lawful [2].
Why Hanafi scholars do not allow oysters
The Hanafi school reads the Qur'an and hadith as permitting fish only. SeekersGuidance explains that in this school, all sea animals other than fish are not allowed [4]. Mufti Online, a Hanafi fatwa service, states the same rule that only fish are permissible from the sea [5].
Oysters are not fish, so they are excluded. Unlike shrimp, which some Hanafi scholars treat as a fish because of how Arabs once classed it, oysters have no such debate. See shrimp for that discussion.
Eating together when views differ
Oysters are one of the seafoods where Muslims at the same table may follow different answers. A Shafi'i or Maliki guest may eat them, while a Hanafi or Shia guest may not [3][4][6]. Neither is breaking their own school's rules.
If you are hosting, it helps to ask guests ahead of time, or to serve oysters alongside a fish dish that every school accepts. Keep serving spoons separate so guests who avoid shellfish can eat the rest of the meal with ease.
The Ja'fari position
Rulings from the office of Ayatollah Sistani state that shellfish is not halal. From the sea, they allow fish with scales and shrimp only [6]. Oysters, clams and mussels all fall outside this. Followers of other Shia scholars should check their own marja's rulings.
Oyster dishes and products: what to check
If oysters are halal for you, look at the rest of the dish:
- Raw oysters are often served with mignonette, which is made with vinegar. Some versions use wine vinegar. See wine vinegar.
- Baked and grilled oysters can be topped with bacon, butter sauces or wine.
- Fried oysters may share a fryer with pork items, or use beer batter.
- Oyster stew and chowder sometimes include bacon or salt pork.
- Oyster sauce is made from oyster extract, so it raises the same school question as oysters.
